Terms and Conditions

  • By submitting your entry you are agreeing to the terms and conditions outlined in this document.

  • Photographs submitted for judging must have been taken within the Newcastle local government area and must reference a bike.

  • Photographs will be judged based on the following criteria: adherence to the brief; creativity; technical execution; and WOW! Factor.

  • Photographs can be submitted into one of three categories, including health and fitness, transport or social.

  • The winner of each category will win a bike themed prize pack of their choice valued at $250. All other finalists will win a unique Newcastle designed 'Beep Bell'.

  • The overall winner will win a bike of their choice up to the value of $1000.

  • Photographs must also be available as high resolution jpegs, as all finalist images will be exhibited at the Newcastle Museum.

  • ​Entrants warrant that photographs submitted by them for judging in the competition are owned by them, and that they hold all intellectual property associated. Only one entry is permitted per person, per category. Entrants must only enter in their own name. Non-compliance with the competition terms and conditions may lead to disqualification from the competition. Entry Content must not include any image or other kind of depiction of any other person (except incidentally and not prominently) without that person’s express consent. If a person is a minor, the express consent of the minor’s parent or guardian must be obtained before being included in any Entry Content (and if the minor is over 13, the minor's express consent must also be obtained). Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person(s).

  • Any entries that contain content that the Council, in its sole discretion, considers to be illegal, contrary to any laws, indecent, obscene, threatening, discriminatory, harassing, in breach of any confidence, defamatory, libellous, offensive or objectionable will not be considered eligible to enter the  competition.

  • ​​Current employees of City of Newcastle (Council) and their families are not eligible to enter.

  • Only entries completed via the official Newcastle City Council Facebook and Instagram pages will be accepted. The competition opens at 7am on 1st September 2018 and closes at midnight on 17th September 2018. Council accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid.  Internet entries will be deemed to be accepted at the time of successful online posting and not at the time of transmission.

  • ​Photographs will be judged and prizes awarded by a panel of Council officers. The overall winner will be decided via a People's Choice online nomination. All judges' decisions are final and no correspondence will be entered into.

  • Entrants agree that photographs submitted to the competition become the intellectual property of Council and can be reproduced and published in Council publications, social media and any other form of internal or external media platform at Council's absolute discretion. 

  • ​The Council is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

  • Council may vary the terms of, or terminate, this competition at any time at its absolute discretion without liability to any entrant, contestant or other person.

  • ​Entrants consent to submitted photographs being reproduced and published by Council in any manner Council wishes, by way of all media, in perpetuity, without payment to the entrant (of royalties, compensation or otherwise). Entries become the property of Council. Once submitted, ownership of the Entry Content transfers to Council and no changes to or withdrawal of an entry will be permitted. Council may, in its absolute discretion, edit, modify, delete, remove or take down any part of Entry Content. Entries will not be returned and Entrants consent to any dealings with their Entry Content that may otherwise infringe their moral rights in an entry. Entrants consent to Council publishing their name and any other information provided as part of their submission on social media and any other form of internal or external media platform at Council's absolute discretion.

  • Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement.

By agreeing to these Entry Conditions you acknowledge and hereby agree:

  • to waive any and all rights that you may have against Council in relation to any loss or injury that is suffered by you or any other person claiming through you, may have against Council as a result of your participation in this competition. 

  • to continually indemnify Council on a full indemnity basis against any claim or proceeding that is made, threatened or commenced, and any liability, loss, (including consequential loss, and loss of profits), damage or expense (including legal costs on a full indemnity basis) that Council incurs or suffers, as a direct or indirect result of my participation in the competition.
