Development Application Notices

In accordance with the Environmental Planning and Assessment Act 1979 and/or City of Newcastle's (CN) Community Participation Plan the below proposed development applications fall into one or more of the following categories and therefore are notified for community awareness.

  • Designated development;
  • Nominated integrated development;
  • Threatened species development;
  • Class 1 aquaculture development;
  • Potentially hazardous or potentially offensive development; or
  • Demolition in Heritage Conservation Area.

Proposed Leases

Proposed Lease for existing Stockton operator 

City of Newcastle (CN) is inviting comments on a proposed lease to the existing operator of 128 Mitchell Street, Stockton NSW 2295 (Lot 2 DP 1249904).  The proposal is for a term of 5 years only.

The grant of the lease is subject to Division 2 of Part 2 of Chapter 6 of the Local Government Act 1993.

Interim Heritage Order Notices

13 Section Street, Mayfield

  • A notice in the NSW Government Gazette was made by City of Newcastle on 19 July 2024 to place an Interim Heritage Order (IHO) on 13 Section Street, Mayfield.
  • The IHO was imposed by Council following consideration of a Preliminary Heritage Assessment, prepared by City of Newcastle during assessment of development application (DA2023/00147) to demolish a two-storey building "Annesley House" and construct additional carparking facilities on site, constituting a threat of harm to the property.
  • The effect of the IHO is to prohibit demolition or alteration of the property at 13 Section Street Mayfield until 19 July 2025. 
  • Following gazettal of the IHO, CN prepared a detailed heritage assessment of the site. The assessment found the building at 13 Section Street Mayfield reaches the local heritage significance threshold. 
  • CN prepared a planning proposal to list the building in schedule 5 of the NLEP 2012. On 23 July 2024, Council resolved to commence the planning proposal process. The planning proposal was forwarded to the Department of Planning, Housing and Infrastructure (Department) for a Gateway determination under Section 3.34 of the EP&A Act. A Gateway determination was issued on 20 August 2024. This allows the planning proposal to progress to public exhibition. It also requires consultation with Heritage NSW. 

14 Sunderland Street, Mayfield

  • A notice in the NSW Government Gazette was made by City of Newcastle on 1 March 2024 to place an Interim Heritage Order (IHO) on 14 Sunderland Street, Mayfield.
  • A preliminary assessment undertaken by Council’s heritage consultants concluded that the property at 14 Sunderland Street, Mayfield meets the criteria for local heritage significance and the lodgement of the Class 1 Appeal constituting a threat of harm to the property, should the appeal be upheld.
  • The effect of the IHO is to prohibit demolition or alteration of the property at 14 Sunderland Street, Mayfield until 1 March 2025. 
  • Following gazettal of the IHO, CN engaged an independent heritage consultant to prepare a heritage assessment of the site. The assessment found the dwelling at 14 Sunderland Street Mayfield reaches the local significance threshold under five criteria. 
  • CN prepared a planning proposal to list the dwelling in schedule 5 of the NLEP 2012. On 25 June 2024, Council resolved to commence the planning proposal process. The planning proposal was forwarded to the Department of Planning, Housing and Infrastructure (Department) for a Gateway determination under Section 3.34 of the EP&A Act. A Gateway determination was issued on 7 August 2024. This allows the planning proposal to progress to public exhibition. It also requires consultation with Heritage NSW. 

22 Victoria Street, Mayfield

  • A notice in the NSW Government Gazette was made by City of Newcastle on 15 March 2024 to place an Interim Heritage Order (IHO) on 22 Victoria Street, Mayfield.
  • A preliminary assessment undertaken by Council concluded that the property at 22 Victoria Street, Mayfield meets the criteria for local heritage significance and the approval of a Complying Development Certificate (CD2024/00071/CDC-004-2004) for the 'Demolition of the existing dwelling and outbuildings; constituting a threat of harm to the property. 
  • The effect of the IHO is to prohibit demolition or alteration of the property at 22 Victoria Street Mayfield until 15 March 2025. 
  • Following gazettal of the IHO, CN engaged an independent heritage consultant to prepare a detailed heritage assessment of the site. The assessment found the building at 22 Victoria Street Mayfield reaches the local heritage significance threshold. 
  • CN prepared a planning proposal to list the building in schedule 5 of the NLEP 2012. On 25 June 2024, Council resolved to commence the planning proposal process. The planning proposal was forwarded to the Department of Planning, Housing and Infrastructure (Department) for a Gateway determination under Section 3.34 of the EP&A Act. Planning Proposal - PP2024/00003 – Cameron's Hill Heritage Conservation Area

  • Public exhibition has commenced for the planning proposal and development controls – Cameron’s Hill Heritage Conservation Area. 
  • A planning proposal to amend Newcastle Local Environmental Plan 2012 is on public exhibition. It intends to establish a new heritage conservation area, known as ‘Cameron’s Hill’.
  • The public exhibition period is Monday 16 September 2024 to Monday 14 October 2024.
